Terms of Use
coDrive is a proprietary app developed by coMakeIT to enables its employees to carpool. coDrive App is offered by coMakeIT to its employees at no cost and is intended only for the purpose of facilitating carpooling and ride sharing by its employees.

1. Acceptance of terms of use
1.1 By using coDrive App (hereinafter referred to as App), you, the User unconditionally agrees and accepts the terms and conditions that we, coMakeIT have stipulated for use of this App and our other services. If you disagree with the outlined terms and conditions, (the “Terms of Use” in this document) please refrain from using this App and our services.
1.2 Please read this agreement carefully. By installing, accessing and using this App and any services made available through or on it, you are agreeing and accepting to the Terms of Use and Privacy Policy that appear below (all of which are called the “Agreement”). This Agreement is made between you and us.
1.3 We reserve the right to amend these terms of use and privacy policy at any time. All amendments to these terms and conditions will be updated on this page. Please refer to this page from time-to-time, so that you stay informed of any such changes.
2. Use of our service
2.1 You represent and warrant that you are competent, eligible, and have the requisite authority to enter into legally binding agreement with us. You shall not use this App and services if you are not competent to contract under the applicable laws, rules and regulations. By installing this App, you explicitly understand and agree that:
- You are 18 years old and is eligible to register
- You are legally eligible to enter into a contract
- You read and understood the terms of use and privacy policy and agree to be bound by them.
2.2 Usage of the service
You acknowledge and agree that coMakeIT has exclusive right to stop, and/or modify the App and its services. You also acknowledge and agree that coMakeIT can at anytime restrict, and/or terminate your user account and prevent you from accessing the App and the services at its sole discretion.
2.3 Access to the services
You will provide complete, accurate, current information about yourself as required by coMakeIT for the registration process for the App and use of the services. coMakeIT reserves the right to suspend and terminate your membership if it has reasonable doubt to suspect the validity of the information provided by you. coMakeIT also reserves the right to share your information with government regulators and law enforcement agencies or any others, with your consent.
2.4 Non-commercial Use
You agree to use coDrive solely for personal, ridesharing purposes (with coMakeIT employees) only, and shall not use it for any commercial or profit making purposes. coMakeIT reserves the right to restrict or terminate users if it has a reasonable belief that the Service is being used for commercial purposes. You also agree that you will not use the services in any manner which is inconsistent with all applicable laws and regulations.
3. Privacy policy
3.1 Collection of personal information
When you use our App and services, we collect and store your personal information which is provided by you from time to time. To deliver better user experience while using the App, we will use personally identifiable information such as email, Date of Birth, Gender, Mobile Number, Address from coMakeIT employee portal, and any other relevant personal information. The information that we request and use will be retained by us and used as described in this privacy policy.
3.2 Collection of non-personal information
We may also collect non-personal information about your usage of our App and services, which may include your IP address & how much time you spend with our App, how often you share a ride, commute times etc.
3.3 Use of personal and non-personal information
We will only use the information we collect or receive to communicate directly with you and to provide services to you. We may use information provided by you to improve the efficiency of the App and our services. We may also use your information to send you Service-related emails (e.g., account verification, changes/updates to features of the Service, technical and security notices etc).
3.4 Storage of information
We store your personal data and information securely in our database in an encrypted format for maximum security. In accordance with the provisions of the GDPR, to keep personal data only for the time necessary for the purposes for which it is processed. Your account data is kept until the request to close your account and archived 1 year after its closure, or 5 years after your last use of our service if you have not closed your account.
3.5 Third-Party services
As the App uses third-party services, we may share your personal information with service providers so that they can provide us with support services such as email origination, receipt or support services, etc. We require these entities not to use your information for any other purpose.

The third-parties use of the data they collect will be governed by their privacy practices. We strongly advise you to review these before providing any personal information to any third-party, and we assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
3.6 Google Play Services
Please be aware that whenever you use our App, and in case of an error, we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other relevant data.
3.7 Cookies
Cookies are files with a small cache of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory. This App does not use “cookies” explicitly. However, the App may use third-party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portion of the App and our services.
3.8 Passwords and account security
You agree and understand that you are responsible to coMakeIT and to third parties for maintaining the confidentiality of passwords associated with any account you use to access the App and our Services. You will be solely responsible for all activities that occur under your account. We will take due care to ensure the confidentiality of your credentials. You agree and acknowledge that in the very unlikely event of your credentials becoming known to a third party on account of an intrusion into coMakeIT’s data base, coMakeIT shall not be made liable for the resulting damages. If you become aware of any unauthorized use of your password or of your account, you agree to notify coMakeIT immediately.
We value your trust in sharing your Personal Information, and we strive to use commercially acceptable means of protecting your personal data. But please be aware that no method of transmission over the internet, or electronic storage is 100% secure and reliable, and we cannot guarantee absolute security of your data.
4. Termination
4.1 Terms can be terminated by users or us. Users may terminate this Agreement (and their account) at any time by emailing us at comakeit.hyd@gmail.com. Please note that coMakeIT may terminate this Agreement and your account at any time and for any reason, this includes but is not limited to the forth mentioned reasons:
a) If you have breached any provisions of the terms of use that are explicitly cited in this document
b) If coMakeIT is required to do so by law.
We maintain sole discretion to bar your use of service in the future, for any or no reason.
5. DISCLAIMER OF WARRANTY & LIMITATION OF LIABILITY
5.1 You expressly understand and agree that coMakeIT does not provide any warranty related with the use of the App and services and you use the App and services provided by coMakeIT at your own risk.
5.2 Any content downloaded or otherwise obtained through the use of the App and our service is downloaded at your own risk and you will be solely responsible for any damage to your computer system or mobile device any other electronic device or loss of data or any other kind of electronic malfunction that results from such download or your use of the service.
5.3 We cannot and do not take responsibility of users of the App and service and we do not confirm their purported identity. You expressly understand and agree that coMakeIT, our subsidiaries, officers, directors, employees or our suppliers shall not be liable and does not warrant, endorse, guarantee, or assume responsibility for any ride you request or provide through the coDrive App, nor does coMakeIT warrant, endorse, guarantee, or assume responsibility for any misbehavior, property damage, including to your vehicle, personal injury, up to and including death, that occurs as a result of the ride or your use of the service and any dispute arising among you and the other users of our service.
5.4 coMakeIT does not warrant, endorse, guarantee, or assume responsibility for any service or any hyperlinked website or service, and we will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.
6. Indemnification
6.1 You agree to indemnify and hold harmless coMakeIT and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, suits, legal proceedings and expenses (including but not limited to attorney’s fees) arising from:
(i) Your use of and access to the App and Service, including any data or content transmitted or received by you.
(ii) Your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above.
(iii) Your violation of any third-party right, including without limitation any right of privacy or intellectual property rights.
(iv) Your violation of any applicable law, rule or regulation.
(v) Any claims or damages that arise as a result of any of your User Content or any that is submitted via your account.
(vi) Any other party’s access and use of the Service with your unique username, password or other appropriate security code or.
(vii) Any and all claims or damages (alleged or actual) that arise as a result of a ride that you provide as a Driver or a ride that you take as a Passenger.
7. Modifications
7.1 coMakeIT reserves the right to make changes to the terms of use from time to time. We keep the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. All changes/revisions would become effective immediately upon being posted on our Website. We strongly recommend all users to read the terms of use and privacy policy from time to time to be updated with changing policy.
8. Notices
8.1 Except as explicitly stated otherwise, any legal or statutory notices to coMakeIT shall be given by certified mail, postage prepaid and return receipt requested to coMakeIT, Plot No. 564/A 39, Road No: 92, Jubilee Hills,Hyderabad-500033
9. Severability
9.1 If any portion of this Terms of Use is held to be unenforceable, the unenforceable clause/portion must be construed as nearly as possible to reflect the original intent of the Parties. The parties shall further if any portion be held unenforceable, resort to replacing such portion with a legally valid and enforceable clause/portion that replicates the meaning and intention of the original clause/portion. The remaining clauses/portions remain in full force and effect.
10. Dispute Resolution and Arbitration
10.1 You and coMakeIT agree that any dispute will be referred to binding arbitration, with the arbitral panel consisting of three arbitrators, one arbitrator being chosen by each party and a third being jointly appointed by the two arbitrators so chosen. The seat of Arbitration shall be at Hyderabad, Telangana state only.
